Leave of absence on compassionate grounds, medical grounds or other grounds
47 Leave of absence on compassionate grounds, medical grounds or other grounds
(1) An authorised medical officer may permit a person to be absent from a
mental health facility for the period, and on the conditions, that the officer
thinks fit.
(2) Permission may be given on compassionate grounds, on the
ground that medical treatment is required or on any other ground the
authorised medical officer thinks fit. Note : A person may also be transferred
from a mental health facility to another health facility on medical grounds
(see section 80).
(3) An authorised medical officer may not grant leave of
absence unless the officer is satisfied that, as far as is practicable,
adequate measures have been taken to prevent the person concerned from causing
harm to himself or herself or others.
