Court may waive consent requirement for appointment
14 Court may waive consent requirement for appointment
(cf PT Act, s 17)
(1) This section applies if a trust instrument requires the
consent of a person to the appointment of a trustee.
(2) The Supreme Court
may direct that consent is not required to the appointment of the NSW Trustee
if-- (a) the person refuses or fails to consent, or
(b) the person is, for
any reason, not capable of consenting.
