Redemption of pawned goods if licence revoked, suspended, surrendered or not renewed
38A Redemption of pawned goods if licence revoked, suspended, surrendered or
not renewed
(1) If a licence is-- (a) revoked or suspended by the Secretary, or
(b)
surrendered or not renewed,
the Secretary may, where the licensed business
concerned consisted of or included pawnbroking, make such order as the
Secretary thinks fit in relation to the redemption of the goods held in the
course of that business.
(2) Without limiting subsection (1), an order under
this section may require a specified person to cause possession of goods to be
given to a person entitled to redeem them at specified premises.
(3) The
specified person is, by force of this section, empowered-- (a) to comply with
the order even though the person is not or is no longer authorised to conduct
a business consisting of or including pawnbroking at the specified premises,
or
(b) to comply with the order even though the person is not or is no longer
authorised to conduct a business consisting of or including pawnbroking
anywhere in the State.
(4) An order under this section has effect despite any
other provision of this Act or the regulations.
(5) A person must not,
without reasonable excuse, fail to comply with an order made under this
section. : Maximum penalty--50 penalty units.
