Eligibility for licence
8 Eligibility for licence
(1) An individual is eligible to hold a licence only if the Secretary is
satisfied that-- (a) he or she is at least 18 years of age, and
(b) he or she
is a fit and proper person to hold a licence and each person with whom he or
she is in partnership in connection with the business concerned is a fit and
proper person to hold a licence, and
(c) he or she is not a
disqualified person, and
(d) he or she is not a controlled member of a
declared organisation within the meaning of the Crimes (Criminal
Organisations Control) Act 2012 . Note--: Controlled members are prohibited
from applying for licences--see section 27 of the Crimes (Criminal
Organisations Control) Act 2012 .
(2) A corporation is eligible to hold a
licence only if the Secretary is satisfied that-- (a) the corporation is a fit
and proper person to hold a licence, and
(b) each director of the corporation
is a fit and proper person to hold a licence, and
(c) the corporation is not
a disqualified person.
(3) If an applicant for a licence has been charged
with an offence involving dishonesty, the Secretary may await the outcome of
proceedings on the charge before determining the application.
