Offence to supply regulated goods by retail after expiry date
36B Offence to supply regulated goods by retail after expiry date
(1) A person who supplies by retail regulated goods after the expiry date that
is, in accordance with a standard that is applicable to the goods, stated on
or in relation to the goods is guilty of an offence. : Maximum penalty--20
penalty units.
(2) A standard is applicable to regulated goods if-- (a) a
standard specified in an order under section 10 of the Commonwealth Act is
applicable to the goods, or
(b) if no such order is applicable to the goods
but the goods are the subject of a monograph in the British Pharmacopoeia in
the case of goods for use in or on humans, or the British Pharmacopoeia
(Veterinary) in the case of goods for use in or on animals--a standard that is
constituted by the statements in that monograph.
Note : Section 10 of the
Commonwealth Act empowers the Commonwealth Minister to make orders determining
standards for therapeutic goods.
