PUBLIC HEALTH (TOBACCO) ACT 2008 - SECT 6
Certain sales prohibited
6 Certain sales prohibited
(1) A person must not sell a tobacco product that is not in the package in
which it was packed by the manufacturer.
(2) A person must not sell
cigarettes as individual items or in a package containing fewer than 20.
(3)
This section does not apply to the sale of single cigars.
(4) For the
purposes of subsection (1), a quantity of tobacco product that exceeds the
amount prescribed by the regulations is presumed to be for the purposes of
sale if-- (a) it is on premises where tobacco products are being sold, and
(b) it is not in the package in which it was packed by the manufacturer.
Any
such presumption is rebuttable.
: Maximum penalty--100 penalty units, in the
case of an individual and 500 penalty units, in the case of a corporation.
