Delegation of functions
21 Delegation of functions
(1) The Authority may delegate to an authorised person any of the functions of
the Authority, other than this power of delegation.
(1A) The Chairperson may
delegate to an authorised person any of the functions (other than this power
of delegation) conferred or imposed on the Chairperson by or under the
environment protection legislation or any other legislation.
(1B) The CEO may
delegate to an authorised person any function, other than this power of
delegation, conferred or imposed on the CEO by or under the
environment protection legislation or any other legislation.
(2) A delegate
may sub-delegate to an authorised person any function delegated-- (a) by the
Authority, if the delegate is authorised in writing to do so by the Authority,
or
(b) by the Chairperson, if the delegate is authorised in writing to do so
by the Chairperson, or
(c) by the CEO, if the delegate is authorised in
writing to do so by the CEO.
(3) In this section,
"authorised person" means-- (a) a member of the staff of the Authority, or
(b) a member of the staff of a Government agency of Victoria, Queensland,
South Australia or the Australian Capital Territory which administers
environment protection legislation, or
(c) a council (within the meaning of
the Local Government Act 1993 ), or
(d) a person of a class prescribed by
the regulations for the purposes of delegations from the Authority or the
Chairperson or both.
