Defence of authority conferred by regulation
121 Defence of authority conferred by regulation
(1) The regulations may, for the purposes of this Part, regulate the carrying
out of an activity that pollutes waters.
(2) It is a defence in proceedings
against a person for an offence against this Part if the person establishes
that-- (a) the pollution resulted from an activity regulated by such a
regulation, and
(b) the requirements of that regulation were not contravened.
