Application for restraining order
232 Application for restraining order
(1) The person bringing the proceedings (as referred to in section 230) may
apply for a restraining order in relation to property of the defendant.
(2)
An application under this section may be made-- (a) in the case of proceedings
taken before the Local Court--to the Land and Environment Court, and
(b) in
the case of other proceedings--to the court before which the proceedings are
brought.
(3) On an application under this section-- (a) the court may, if it
thinks fit, require the person making the application to give notice of the
application to a person who the court has reason to believe has an interest in
the property or part of the property, and
(b) a person to whom the court
requires notice to be given under paragraph (a) is entitled to appear and to
adduce evidence at the hearing of the application.
