Amount of financial assurances
300 Amount of financial assurances
(1) Determination of amount The amount of a financial assurance is to be as
determined by the appropriate regulatory authority.
(2) Limit on amount
However, the appropriate regulatory authority must not require financial
assurances of an amount that exceeds the total cost of carrying out the
relevant work or program. That total cost is the amount that, in that
authority's opinion, represents a reasonable estimate of the total likely
costs and expenses that may be incurred in carrying out the work or program
required by or under this Act for which the financial assurance is required,
including the likely costs and expenses of that authority in directing and
supervising the carrying out of the work or program.
(3) Costs of assessment
The appropriate regulatory authority may require the holder or former holder
of a licence who is required to give a financial assurance to provide to the
authority an independent assessment of the cost of the relevant work or
program for which the assurance is required.
