Service of documents on persons generally
254 Service of documents on persons generally
(1) Any document that is authorised or required by or under this Act to be
given to or served on any person (other than a corporation) may be given or
served-- (a) personally, or
(b) by means of a letter addressed to the person
and sent by post to the person's address, or
(c) by means of a letter
addressed to the person and left at the person's address with a person who
appears to be of or above the age of 16 years and to reside at that address.
(2) Any document that is authorised or required by or under this Act to be
given to or served on any person (being a corporation) may be given or
served-- (a) by means of a letter addressed to the corporation and sent by
post to the address of any of its registered offices, or
(b) by means of a
letter addressed to the corporation and left at the address of any of the
corporation's registered offices with a person who appears to be of or above
the age of 16 years and to be employed at that address.
(3) Without limiting
subsections (1) and (2), any document that is authorised or required by or
under this Act to be given to or served on the owner or occupier of land may
be given or served by means of a letter addressed to the owner or occupier and
affixed to some conspicuous part of the land.
(4) Any direction or notice
that is required to be served on the owner or occupier of land is taken to be
duly served if, where there is more than one owner or occupier, it is served
on any one of the owners or occupiers.
Note : Section 103 of the Native
Title (New South Wales) Act 1994 makes special provision with respect to the
service of notices on native title holders where there is no
approved determination of native title. Relevant provisions are also made by
the Commonwealth Native Title Act.
