Fixing the levels of public road
29 Fixing the levels of public road
(1) A roads authority may prepare a proposal--
(a) to fix the levels of a
public road, or
(b) to vary the existing levels of a public road.
making an order to give effect to the plan, the roads authority must cause
notice of the proposal--
(a) to be published in a local newspaper, and
be conspicuously displayed at regular intervals along the road concerned.
(a) must indicate the place at which, and the times during which,
a plan of the proposed levels is available for inspection by members of the
(b) must state that adjoining landowners are entitled to make
submissions to the roads authority with respect to the proposal, and
indicate the manner in which, and the period (being at least 28 days) within
which, any such submission should be made.
(4) The roads authority must
ensure that copies of the plan of proposed levels are available for inspection
by members of the public at the place, and during the times, specified in the
