Fences and floodgates
96 Fences and floodgates
(1) For the purpose of preventing obstruction to the free flow of surface
drainage from a public road, or to the free flow of a watercourse that crosses
a public road, the appropriate roads authority may direct the occupier of any
land in the vicinity of the public road-- (a) to alter a fence (including a
rabbit proof fence) on the land, or
(b) to provide floodgates in any such
fence, or
(c) to repair any such fence or floodgates.
(2) The direction may
specify-- (a) the manner in which or the standard to which, and
(b) the
period (being at least 28 days) within which,
the direction must be complied
with.
