Protection as to notice of person contracting or dealing in respect of land under this Act before registration
43A Protection as to notice of person contracting or dealing in respect of
land under this Act before registration
(1) For the purpose only of protection against notice, the estate or interest
in land under the provisions of this Act, taken by a person under a dealing
registrable, or which when appropriately signed by or on behalf of that person
would be registrable under this Act shall, before registration of that
dealing, be deemed to be a legal estate.
(2) No person contracting or dealing
in respect of an estate or interest in land under the provisions of this Act
shall be affected by notice of any instrument, fact, or thing merely by
omission to search in a register not kept under this Act.
(3) Registration
under Division 1 of Part 23 of the Conveyancing Act 1919 shall not of itself
affect the rights of any person contracting or dealing in respect of estates
or interests in land under the provisions of this Act.
(4) Nothing in
subsection (2) or (3) operates to defeat any claim based on a subsisting
interest, within the meaning of Part 4A, affecting land comprised in a
qualified folio of the Register.
