RAIL SAFETY NATIONAL LAW (NSW) - SECT 160
Rail safety officer may direct a thing's return
160 Rail safety officer may direct a thing's return
(1) If a rail safety officer has directed a person to take a thing to a
specified place within a specified time under section 159(1), a rail safety
officer may direct the person to return the thing to the place from which it
was taken.
(2) A person given a direction under subsection (1) must comply
with that direction unless the person has a reasonable excuse. : Maximum
penalty--$5 000.
(3) Subsection (2) places an evidential burden on the
accused to show a reasonable excuse.
