RESIDENTIAL TENANCIES ACT 2010 - SECT 42
Rent increases under fixed term agreements
(1) The rent payable under a fixed term agreement for a fixed term of less
than 2 years must not be increased during the fixed term unless the agreement
specifies the increased rent or the method of calculating the increase.
(2)
The rent payable under a fixed term agreement for a fixed term of 2 years or
more-- (a) must not be increased more than once in any period of 12 months,
and
(b) may be increased whether or not the agreement specifies the increased
rent or the method of calculating the increase.
(3) A landlord or landlord's
agent must not increase the rent payable under a fixed term agreement in
contravention of this section. : Maximum penalty--20 penalty units.
