SURROGACY ACT 2010 - SECT 44
Power of Court to discharge parentage order
(1) On an application under this Part, the Court may make an order discharging
a parentage order in relation to a child.
(2) However, the Court may make the
order only if it is satisfied of one of the following: (a) the parentage order
was obtained by fraud, duress or other improper means,
(b) a consent the
Court making the parentage order considered had been given to the making of
the parentage order was, in fact, not given or was given for payment, reward
or other material benefit or advantage (other than the birth mother's
surrogacy costs),
(c) there is an exceptional reason why the parentage order
should be discharged.
