(a) a notice referred to in section 23 (1) is served on the Commissioner less than 7 days before the date specified in the notice as the date on which it is proposed to hold the public assembly referred to in the notice, and
(b) the Commissioner has not notified the organiser of the public assembly that the Commissioner does not oppose the holding of the public assembly,the organiser may apply to a Court for an order authorising the holding of the public assembly.
