SALE OF GOODS ACT 1923 - SECT 38
Acceptance
38 Acceptance
(1) The buyer is deemed to have accepted the goods when the buyer intimates to
the seller that the buyer has accepted them, or, subject to section 37, when
the goods have been delivered to the buyer and the buyer does any act in
relation to them which is inconsistent with the ownership of the seller, or
when after the lapse of a reasonable time the buyer retains the goods without
intimating to the seller that the buyer has rejected them.
(2) The buyer's
acceptance of the goods as referred to in subsection (1) does not preclude
rescission of the contract for an innocent misrepresentation, unless the acts
constituting acceptance amount to affirmation of the contract.
