Disputes about operation of Act
17 Disputes about operation of Act
(1) If there is a dispute between a public office and the Authority or Museums
of History NSW about the operation of this Act as it relates to a function
conferred on the Authority or Museums of History NSW, either party may request
a review of the matter by-- (a) the Ministers responsible for each party, or
(b) if the same Minister is responsible for both parties--the Minister
responsible for both parties.
(2) The parties must make a reasonable effort
to resolve the dispute before requesting a review.
(3) A decision of the
Authority to permit or not to permit, or to approve a practice or procedure
involving, an act referred to in section 21(1) may not be reviewed.
(4) If
the dispute is not resolved by the responsible Minister or Ministers, it must
be referred to-- (a) the Premier, or
(b) another Minister designated by the
Premier in a particular case.
(5) Both parties must comply with a direction
given by the Premier or the designated Minister to resolve the dispute.
