Direction of court to treat application differently
133 Direction of court to treat application differently
(1) If the court considers that a variation order should not be made, it may,
on application made by any person entitled to appear and be heard on the
hearing of the application for the order or on its own initiative, direct that
the application be treated as an application for an order under section 136.
(2) If the court makes a direction under subsection (1)-- (a) the application
the subject of the direction is taken to be made under section 135 by a person
entitled to make the application, and
(b) the applicant for the variation
order, and any other person entitled to appear and be heard under that
section, is entitled to appear and be heard on the hearing of the application.
