Lessor may refuse to grant further leases
45 Lessor may refuse to grant further leases
(1) The lessor of a leasehold strata scheme may refuse to grant a further
lease of a lot to an owner if-- (a) the owner has breached a provision of the
lease of the lot and the breach has not been remedied, or
(b) the owner has
not complied with a provision of the lease for the renovation of improvements
comprised in the lot.
(2) The lessor of a leasehold strata scheme may refuse
to grant a further lease of the common property to the owners corporation if--
(a) the owners corporation has breached a provision of the lease of the
common property and the breach has not been remedied, or
(b) the
owners corporation has not complied with a provision of the lease for the
renovation of improvements comprising common property.
(3) If a lessor
refuses to grant a further lease of the common property in a
leasehold strata scheme, the lessor must also refuse to grant further leases
of lots in the scheme.
(4) This section applies despite section 44 (4).
