TRUSTEE ACT 1925 - SECT 100
Escheat
100 Escheat
(1) Property vested in any person upon any trust or by way of mortgage shall
not escheat or be forfeited to the Crown by reason of the attainder or
conviction for any offence of the trustee or mortgagee.
(2) Property so
vested shall remain in the trustee or mortgagee or survive to his or her
co-trustee, or vest in his or her legal representative as if the attainder or
conviction had not taken place.
(3) This section shall not prevent the
escheat or forfeiture of any property vested in any trustee or mortgagee so
far as relates to any beneficial interest therein of the trustee or mortgagee,
but the property, so far as relates to any such beneficial interest, shall be
recoverable in the same manner as if this Act had not been passed.
