Limitation on liability
11 Limitation on liability
(1) Any act, matter or thing done or omitted to be done by the Minister (or by
any other natural person, whether or not acting on behalf of the State, being
a person engaged, or involved in performing any function, in connection with
the carrying out the works) does not subject the Minister (or the person)
personally to any action, liability, claim or demand, if the act, matter or
thing was done or omitted to be done in good faith for the purpose of carrying
out the works.
(2) An action for nuisance connected with or in any way
arising out of any act, matter or thing done or omitted to be done in carrying
out the works, or an action for the abatement or remedying of any such
nuisance, may not be brought against the State, the Minister or any other
person (including a corporation) involved in carrying out the works or
performing any function in connection with the carrying out of the works,
whether or not the other person was acting on behalf of the State.
(3) This
section applies whether the act, matter or thing concerned was done or omitted
to be done before or after the commencement of this section and so applies
despite any other Act or law.
