47 Appointments to positions generally

(1) The Secretary may, subject to section 47A, appoint to positions in the Teaching Service:

(a) persons who are accredited under the Teacher Accreditation Act 2004 , or

(b) persons who have, in the opinion of the Secretary, the appropriate qualifications to be employed in the Teaching Service.

(1A) Where:

(a) an appointment to a position in the Teaching Service (other than a senior position) is to be made under subsection (1), and

(b) an Aboriginal and a person who is not an Aboriginal, each of whom is eligible to be appointed to the position, are offering themselves for appointment to the position,

the Secretary shall give preference to the Aboriginal or, if there are 2 or more such Aborigines, give preference to any one of them by appointment to that position.
