VICTIMS RIGHTS AND SUPPORT ACT 2013 - SECT 35
Categories of recognition payment
(1) A
"category A recognition payment" is a payment given in respect of an
act of violence or act of modern slavery that apparently occurred in the
course of the commission of a homicide.
(2) A
"category B recognition payment" is a payment given in respect of an
act of violence or act of modern slavery of the following kinds-- (a) a
sexual assault resulting in serious bodily injury or which involved an
offensive weapon or was carried out by 2 or more persons,
(b) a
sexual assault, sexual touching or sexual act or attempted sexual assault
involving violence that is one of a series of related acts.
(3) A
"category C recognition payment" is a payment given in respect of an
act of violence or act of modern slavery involving any of the following-- (a)
a sexual assault other than one referred to in subsection (2) (b),
(b) an
attempted sexual assault resulting in serious bodily injury,
(c) an assault
resulting in grievous bodily harm,
(d) physical assault of a child that is
one of a series of related acts.
(4) A
"category D recognition payment" is a payment given in respect of an
act of violence or act of modern slavery involving any of the following-- (a)
sexual touching or sexual act,
(b) an attempted sexual assault involving
violence other than one referred to in subsection (3) (b),
(c) a robbery
involving violence,
(d) an assault (not resulting in grievous bodily harm).
