Cancellation and suspension of licences
117H Cancellation and suspension of licences
(1) The Ministerial Corporation may cancel or suspend a licence if it is
satisfied that the licensee has failed to comply with: (a) any limitation or
condition of the licence, or
(b) any requirement imposed by or under this
Part,
whether or not the licensee has been prosecuted or convicted for an
offence arising out of that failure to comply.
(2) Before taking any action
under this section, the Ministerial Corporation: (a) must cause written notice
of the proposed action to be given to the licensee, and
(b) must give the
licensee a reasonable opportunity to make written submissions to the
Ministerial Corporation with respect to the proposed action, and
(c) must
have regard to any submission that is duly made.
