WORKERS COMPENSATION ACT 1987 - SECT 279A
Workers compensation liability with respect to staff of statutory bodies
279A Workers compensation liability with respect to staff of statutory bodies
(1) Part 5 applies to work injury damages recoverable from the Government of
New South Wales, and to work injury damages recoverable from a statutory body,
by or in respect of a person employed in the Public Service to enable the
statutory body to exercise its functions. Part 5 so applies as if-- (a) the
statutory body were an employer of the person in addition to the Government,
and
(b) the statutory body were an employer liable to pay compensation under
this Act.
(2) A policy of insurance may be issued to the Government of New
South Wales under this Act that is limited to workers employed in a particular
part of the Public Service.
(3) A licence under Division 5 of Part 7 that is
limited to workers employed in a particular part of the Public Service may be
granted to the Government of New South Wales.
(4) In this section--
"Public Service" includes the Transport Service of New South Wales.
"work injury damages" means work injury damages recoverable from a statutory
body or the Government of New South Wales in respect of injury to or the death
of a person employed in the Public Service to enable the statutory body to
exercise its functions caused by the negligence or other tort of the statutory
body or the Government and arising out of the employment of the person by the
Government.
