WORKPLACE INJURY MANAGEMENT AND WORKERS COMPENSATION ACT 1998 - SECT 318I

318I Orders for access to information and premises
(1) If there is no dispute that the degree of permanent impairment of an
injured worker is sufficient for an award of damages, the President may on the
application of the claimant give either or both of the following written
directions to the defendant-- (a) a direction directing the defendant to
produce to the claimant within a specified period specified reports and other
documents in the defendant's possession,
(b) a direction directing the
defendant to provide or allow the claimant access to specified premises within
a specified period for a purpose relevant to the claimant's claim.
(2) A
person who fails without reasonable excuse to comply with a direction given to
the person under this section is guilty of an offence. : Maximum penalty--50
penalty units.
Note--: The Commission also has power under section 49 of the
Personal Injury Commission Act 2020 to require the production of documents and
the furnishing of information by the parties.
