Elections to fill casual vacancies

41 Elections to fill casual vacancies

(1) For the purposes of section 68 of the Act, an election to fill a vacancy in the position of a Board member must be held in accordance with this clause.
(2) An election for the position is to be conducted by the Registrar.
(3) A person may nominate another person to stand for election as a Board member by notice in writing to the returning officer or the returning officer's delegate at or before the time when nominations are called for at the meeting of the Local Aboriginal Land Council at which the election is held.
(4) For a nomination to be valid, the person nominated must give consent to the nomination before the election is held and the consent must be recorded in the minutes of the meeting of the Local Aboriginal Land Council at which the election is held.
(5) If only one nomination is received for the position, the nominated candidate must be declared elected.
(6) In any other case, a ballot must be held for each position.
(7) A ballot held under this clause must be held in the same manner as a ballot for the position of a Board member and the provisions of this Division apply accordingly.
