(1) The objective of this clause is to prevent substandard residential accommodation occurring through the conversion of serviced apartments to a residential flat building.
(2) Development consent must not be granted for the subdivision, under a strata scheme, of a building or a part of a building that is being, or has been, used for serviced apartments into a residential flat building unless the consent authority has considered the following in relation to the residential flat building--(a) the design quality principles set out in Schedule 1 to State Environmental Planning Policy No 65--Design Quality of Residential Apartment Development ,(b) the design principles of the Apartment Design Guide (within the meaning of that Policy).
