CRIMINAL PROCEDURE REGULATION 2017 - REG 117
Election not to have indictable offence dealt with summarily
117 Election not to have indictable offence dealt with summarily
(1) For the purposes of section 265 (1) (b) of the Act, Form 5 is the
prescribed form of words for the statement about a person's right to make an
election and the consequences of not making an election.
(2) For the purposes
of section 266 (2) (a) of the Act, an election may be made orally to the Local
Court or by filing a written notice with the Court.
(3) For the purposes of
section 266 (2) (b) of the Act, the withdrawal of an election may be made
orally to the Local Court or by filing a written notice with the Court.
