MAITLAND LOCAL ENVIRONMENTAL PLAN 2011 - SCHEDULE 1

SCHEDULE 1 – Additional permitted uses

(Clause 2.5)

1 Use of certain land at 35 Paterson Road, Bolwarra

(1) This clause applies to Lot 4010, DP 1023182, being 35 Paterson Road, Bolwarra.
(2) Development for the purpose of a restaurant or cafe is permitted with development consent.

2 Use of certain land at 1 Garnett Road, Greenhills

(1) This clause applies to Lot 701, DP 629585, being 1 Garnett Road, Greenhills.
(2) Development for the purpose of a place of public worship is permitted with development consent.

3 Use of certain land at St Helena Close, Lochinvar

(1) This clause applies to Lot 10, DP 1177217 and Lot 200, DP 1111493, being 9 and 15 St Helena Close, Lochinvar.
(2) Development for the purpose of a cellar door premises, entertainment facility, function centre, markets, restaurant or cafe, or shop is permitted with development consent.

4 Use of certain land at 71 Belmore Road, Lorn

(1) This clause applies to Lot 21, DP 873062, being 71 Belmore Road, Lorn.
(2) Development for the purpose of a dwelling house is permitted with development consent.

4A Use of certain land at 37 and 45 Alnwick Street, Millers Forest

(1) This clause applies to Lots 20 and 21, DP 836869, being 37 and 45 Alnwick Street, Millers Forest.
(2) Development for the purpose of a hazardous storage establishment (being for the storage of fireworks) is permitted with development consent.

5 Use of certain land at 3 Brush Farm Road, Raworth

(1) This clause applies to Lot 1, DP 226025, being 3 Brush Farm Road, Raworth.
(2) Development for the purpose of a dwelling house is permitted with development consent.

6 Use of certain land at Racecourse Road, Rutherford (Heritage Green)

(1) This clause applies to Lot 1504, DP 1141535 being land at Racecourse Road, Rutherford (Heritage Green).
(2) Development for the purposes of residential accommodation of up to 450 dwellings in a community title scheme (within the meaning of the Community Land Development Act 1989 ), a recreation facility (outdoor) and associated business premises and retail premises is permitted with development consent.

7 Use of certain land at Huntingdale Drive, Thornton

(1) This clause applies to Lot 824, DP 1032401, being Huntingdale Drive, Thornton.
(2) Development for the purpose of an educational establishment is permitted with development consent.

8 Use of certain land at 46 and 48 Banks Street, East Maitland

(1) This clause applies to Lot 1, DP 199405 and Lot 1, DP 716770, being 46 and 48 Banks Street, East Maitland.
(2) Development for the purpose of a mortuary is permitted with development consent.

9 Use of certain land at 56 Kyle Street, Rutherford

(1) This clause applies to Lot 3, DP 790460, being 56 Kyle Street, Rutherford.
(2) Development for the purpose of a recreation facility (outdoor) for the purpose of motorcycle activities is permitted with development consent.

10 Use of certain land at 11 Metford Road, East Maitland

(1) This clause applies to Lot 1, DP 1274406, 11 Metford Road, East Maitland.
(2) Development for the purposes of animal boarding or training establishments is permitted with development consent.

11 Use of certain land at 5-13 Louth Park Road, South Maitland

(1) This clause applies to the following land at South Maitland--
(a) Lot 6, DP 199882 and Lots 17 and 18, DP 1044795, 5 Louth Park Road,
(b) Lot 1, DP 794525, 7 Louth Park Road,
(c) Lot 4, DP 1109043, 9 Louth Park Road,
(d) Lots 1-3, DP 1109043, 11 Louth Park Road,
(e) Lot 1, DP 782596, 13 Louth Park Road.
(2) Development for the purposes of service stations and takeaway food and drink premises is permitted with development consent.

12 Use of certain land in Zone E3 for shop top housing

Development for the purposes of shop top housing is permitted with development consent on land in Zone E3 and identified as "Area A" on the Land Zoning Map .

13 Use of certain land at 19 Scotch Creek Road, Millers Forest

(1) This clause applies to Lot 1, DP 721804, 19 Scotch Creek Road, Millers Forest.
(2) Development for the purposes of light industries that involve sand and gravel processing are permitted with development consent.

14 Use of certain land at 24 Hunter Street, Horseshoe Bend

(1) This clause applies to part of Lot 1, DP 1261532, 24 Hunter Street, Horseshoe Bend, identified as "Horseshoe Bend Area 1" on the Additional Permitted Uses Map .
(2) Development for the purposes of educational establishments is permitted with development consent.
