for a person not returned and a respondent wishes to contend, upon a ground
not mentioned in rule 20 (2), that that person was not duly elected, he shall,
not later than 14 days before the day appointed for the trial, serve on the
petitioner a statement of the facts upon which he intends to rely and the
grounds of the contention.
