Decennial insurance criteria
55A Decennial insurance criteria
(1) For the Act, section 211AA(2)(a), decennial insurance for a building
must-- (a) not permit cancellation, whether by the developer or another party
to the policy,
(b) be issued before an application is made for an occupation
certificate under the Environmental Planning and Assessment Act 1979 for any
part of the building.
(2) To avoid doubt, insurance complies with subclause
(1)(b) if the insurance is issued before the application for the occupation
certificate subject to a condition that the insurance does not take effect
until the occupation certificate is issued.
