(1) A person conducting a business or undertaking must ensure that the health monitoring of a worker referred to in clause 368 is carried out by or under the supervision of a registered medical practitioner with experience in health monitoring.: Maximum penalty--(a) in the case of an individual--70 penalty units, or(b) in the case of a body corporate--345 penalty units.
(2) The person must consult the worker in relation to the selection of the registered medical practitioner.: Maximum penalty--(a) in the case of an individual--40 penalty units, or(b) in the case of a body corporate--210 penalty units.
