This legislation has been repealed.
(1) The objective of this clause is to ensure that any land excavation or filling work will not have a detrimental impact on environmental functions and processes, neighbouring uses, or cultural or heritage items and features.
(2) Consent for excavation of land or the placing of fill may be granted only if the consent authority is satisfied that there would be no adverse impact on:(a) a waterbody, or(b) private or public property, or(c) ground water quality and resources, or(d) stormwater drainage, or(e) flooding.
