This legislation has been repealed.
(1) A licensee must give the Director-General a nomination in writing of a person as an auditor of the licensee's safety and operating plan at least one month before the person is first required to give a certificate in relation to the plan under this Division.Maximum penalty: 10 penalty units.
(2) A person may not be nominated as an auditor under this clause unless the person is:(a) independent of the licensee, and(b) competent to exercise the functions of an auditor under this Regulation in respect of the licensee's safety and operating plan.
(3) If the Director-General advises a licensee in writing that a nomination is not accepted or is no longer acceptable, the nomination ceases to have effect for the purposes of this Regulation.
