(1) Except as provided by this clause, a person who is on a promotion list for a rank is to be included on any replacement promotion list if the person remains eligible to be placed on such a promotion list.
(2) A person may not be included in a replacement promotion list if the person was last awarded an eligibility mark more than 3 years before the promotion list is established.
