The Legislative Assembly of the Northern Territory enacts as follows:

1. Short title
This Act may be cited as the Bail Amendment Act 2003.

2. Commencement
This Act comes into operation on the date fixed by the Administrator by notice in the Gazette.

3. New section
The Bail Act is amended by inserting after section 24 in Part V, Division 1 the following:

"24A. Punishment under customary or religious law not relevant

"(1) In making a determination as to the grant of bail to an accused person, an authorised member or a court cannot take into consideration the need of the person to be free to receive punishment under any customary or religious law.

"(2) For section 24(1)(b)(iii), receipt of punishment under any customary or religious law is not a lawful purpose.".
