MOTOR VEHICLES AMENDMENT BILL 2003

8AA. Registration of quad bikes

1. Short title
This Act may be cited as the Motor Vehicles Amendment Act 2003.

2. Principal Act
The Motor Vehicles Act is in this Act referred to as the Principal Act.

3. New section
The Principal Act is amended by inserting after section 8 the following:

"8AA. Registration of quad bikes

"(1) Despite section 8, the Registrar must register, and from time to time renew the registration of, a quad bike.

"(2) Registration or renewal of registration of a quad bike is subject to the condition that it is used only by the registered owner in a rural area during daylight hours.

"(3) In addition, the Registrar may register or renew the registration of a quad bike subject to the other conditions the Registrar considers appropriate.

"(4) For section 13(1), the prescribed fee for the registration or renewal of registration of a quad bike is $20.

"(5) Section 16(1) does not apply to the registration or renewal of registration of a quad bike.

"(6) In this section –

'quad bike' means an all terrain vehicle that –
(a) has an efficient braking system capable of stopping and holding it;

(b) is fitted with lights that comply with the applicable Australian Design Rule; and

(c) otherwise complies with the standards and specifications prescribed by the Regulations;

'rural area' means the part of the Territory prescribed by the Regulations.".
