EXPLANATORY STATEMENT
GENERAL OUTLINE

The purpose of this Bill is to amend the Domestic and Family Violence Act so that it is clear that a court or police officer when making a domestic violence order can make an ancillary order that aims to ensure compliance by the defendant with domestic violence orders.

NOTES ON CLAUSES

Clause 1. Short title

This is a formal clause which provides for the citation of the Bill. The Bill when passed may be cited as the Domestic and Family Violence Amendment Act 2012.

Clause 2. Commencement

The Act will commence on the day fixed by the Administrator by Gazette notice.

Clause 3. Act amended

This clause provides that the Domestic and Family Violence Amendment Act 2012 will amend the Domestic and Family Violence Act.

Clause 4. Section 21 amended

Clause 4 amends section 21 of the Domestic and Family Violence Act by providing that a court or police officer when making a domestic violence order can impose an ancillary order that aims to ensure compliance by the defendant with other orders.

New section 21(1A) will provide that an ancillary order may either prohibit the defendant from engaging in specified conduct or require the defendant to take specified action.

New section 21(1B) states that Regulations may also make provision in relation to an ancillary order.
