EXPLANATORY STATEMENT

GENERAL OUTLINE

This Bill is to amend the Electoral Act and the Electoral Regulations. The new Act will reverse the decision by the previous Government to introduce optional preferential voting and to allow a return to full preferential voting.

.NOTES ON CLAUSES

Clause 1. Short title

This is a formal clause which provides for the citation of the Bill. The Bill when passed may be cited as the Electoral Legislation Amendment Act 2016..

Clause 2. Act amended

This part amends the Electoral Act

Clause 3. Section 50 amended

This clause omits what is presently in the act and inserts the previous requirement in the original Act requiring a person to place consecutive numbers in all squares starting with the number’1’.

Clause 4. Section 94 amended

This clause inserts omits 94(2) to 3A and inserts new clauses explaining how some variations on the requirements of Section 50 (2) can still be acceptable as a valid vote.

Clause 5. Section 128 amended

This clause omits certain words applicable when optional preferential voting was permitted. The section reverts back to the original legislation in regards to counting preferences when there is the full preferential system.

· Clause 6. Part 20 inserted

This contains the transitional provisions for this Bill.

Clause 7 Regulations amended

· This part amends the Electoral Regulations.

Clause 8 Regulation 5 inserted

· This inserts transitional provisions for the regulations

Clause 9 Schedule Amended

This clause omits all words from ‘Place’ to ‘count’ and inserts the requirement to number all boxes.

Clause 10 Expiry of Act

Says when the Act expires.
