EXPLANATORY STATEMENT


GENERAL OUTLINE

This Bill amends the Local Government Grants Commission Act.

The primary purpose of this Bill is to allow the Northern Territory Grants Commission more time to lodge their annual report on their activities with the Minister. The amendment will align the timing of the Commission’s reporting requirements with those of councils under the Local Government Act.

The secondary purpose of the Bill is to amend the definition of ‘municipal council’ by removing an incorrect reference to a definition in the repealed Local Government Act.

NOTES ON CLAUSES

Clause 1. Short Title.

This is a formal clause which provides for the citation of the Bill. The Bill when passed will be cited as the Local Government Grants Commission Amendment Act 2009.
Clause 2. Act Amended.

This clause states that this Bill is amending the Local Government Grants Commission Act.

Clause 3. Amendment of section 3 (Definitions).

This clause amends the definition section of the Local Government Grants Commission Act by omitting the definition of “municipal council” in its entirety, as well as the words “, unless the contrary intention appears”. The definition of “municipal council” has been omitted as it is no required.

Clause 4. Amendment of section 16 (Report of Commission).

This clause amends section 16 of the Local Government Grants Commission Act so as to allow the Commission to submit its report on the activities of the Commission during the previous financial year to the Minister by 15 November of each year.
