EXPLANATORY STATEMENT

GENERAL OUTLINE

This Bill amends the Licensed Surveyors Act.

The purpose of this Bill is to amend the reporting requirements of the Surveyors Board of the Northern Territory.

NOTES ON CLAUSES

Clause 1. Short Title.

This is a formal clause and provides that the Bill, when passed, may be cited to as the Licensed Surveyors Amendment Act 2018.

Clause 2. Commencement.

This is a formal clause which provides that the Act will commence on a day fixed by the Administrator by Gazette notice.

Clause 3. Act amended

This is a formal clause that provides that this Act will amend the Licensed Surveyors Act.

Clause 4. Section 21 replaced

This clause repeals existing section 21 and replaces it with a new section 21 which provides that the Surveyors Board of the Northern Territory must, at the end of each financial year, provide the responsible minister with a report on their activities within six months, or another period specified by the Minister, of the end of the financial year.

The Minister must table this report in the Legislative Assembly within six days of receiving it.

Clause 5. Repeal of Act

This is a standard clause which provides that the Licensed Surveyors Amendment Act 2018 is repealed on the day after it commences.

STATEMENT OF COMPATIBILITY WITH HUMAN RIGHTS

Prepared in accordance with the Thirteenth Assembly Sessional Orders (part 12.3) as adopted on 24 August 2017.

This bill is compatible with the human rights and freedoms recognised or declared in the international instruments listed in section 3 of the Human Rights (Parliamentary Scrutiny) Act 2011 (Cth).

OVERVIEW OF THE BILL

The Bill makes changes to the reporting requirements of the Surveyors Board of the Northern Territory (Board). When passed, the Board will no longer be required to provide an audited financial statement from the Auditor-General when presenting their annual report to the responsible Minister.

HUMAN RIGHTS IMPLICATIONS

This bill does not engage any of the applicable rights or freedoms.

The amendment will save the Surveyors Board of the Northern Territory approximately $7 000 per annum and the savings can be used to improve member services

CONCLUSION

This bill is compatible with human rights and freedoms recognised or declared in the international instruments listed in section 3 of the Human Rights (Parliamentary Scrutiny) Act 2011 (Cth) as it does not raise any human rights issues.
