EXPLANATORY STATEMENT


GENERAL OUTLINE

§ This legislation seeks to provide the Chairperson with discretion to schedule members appointed pursuant to section 3B(1)(d) to meetings constituted pursuant to section 3EB(2).
§ The legislation will provide members with access to expertise in the interpretation of psychological and treatment reports for prisoners with complex or high needs.

NOTES ON CLAUSES

Clause 1. Short Title.

This is a formal clause which provides for the citation of the Bill. The Bill when passed may be cited as the Parole Amendment Act 2014.

Clause 2. Act Amended.

This is a formal clause which identifies the legislation that is being amended. This Act amends the Parole Act.


Clause 3. Section 3EB amended.

This clause identifies the changes to the constitution of a meeting considering matters for any other prisoner than those serving a life sentence for the crime of murder.

Clause 4(1) adds the word ‘and’ to the end of the clause to allow for a new clause (d) to be inserted.

Clause 4(2) inserts the new clause (d) into section 3EB(2) ‘if the Chairperson considers it desirable – one other member of the Board nominated by the Chairperson who must be a member mentioned in section 3B(1)(d)’.
