Planning Amendment Bill 2016
EXPLANATORY STATEMENT
GENERAL OUTLINE
The Bill is called the Planning Amendment Bill 2016 and the object of this Bill is to return the role of the reporting body as described in Sections 22, 23 and 24 of the NT Planning Act to the Development Consent Authority.
NOTES ON CLAUSES
Clause 1. Short title
The Act may be sited as the Planning Amendment Act 2016
Clause 2. Act amended
The Act amends the Planning Act
Clause 3. Section 3 amended
This clause inserts two new definitions of prescribed functions and reporting body
Clause 4. Section 17 amended
This clause omits the word ‘body’ and inserts ‘person or body’ to which a submission may be sent.
Clause 5. Section 20 amended
This clause inserts a definition of prescribed functions and inserts and refers the definition of reporting body to the next section 21body
Clause 6. Part 21 amended
This clause inserts a definition of a reporting body
Clause 7. Section 22 amended
This clause omits references to the commission.
Clause 8 Section 23 amended
This clause omits references to the commission
Clause 9. Section 24 amended
This clause replaces references to commission and replaces it with references to the reporting body.
Clause 10 Section 81B amended
Removes powers of commission over Part 2 Division 4 of the Planning Act and directions by the Minister
Clause 11 Part 12 Division 6 inserted
This clause inserts into the Planning Amendment Act 2016 some definitions and explanations re proposals placed on exhibition before commencement
Clause 12 Expiry of Act
This clauses explains hen the Act expires.
