ENVIRONMENT PROTECTION (BEVERAGE CONTAINERS AND PLASTIC BAGS) ACT 2011 - SECT 16

Approval required for collection depot operator

    (1)     A person must not operate a collection depot unless the person is the holder of a collection approval.

Fault element:     The person intentionally operates a collection depot.

Maximum penalty:     200 penalty units.

    (2)     It is a defence to a prosecution for an offence against subsection (1) if the defendant has a reasonable excuse.
