ENVIRONMENT PROTECTION (BEVERAGE CONTAINERS AND PLASTIC BAGS) ACT 2011 - SECT 42

    (1)     A person commits an offence if:

        (a)     the person is the holder of a CDS approval or is a CDS supplier; and

        (b)     the person intentionally engages in conduct; and

        (c)     the conduct results in a contravention of a condition of the person's CDS approval or registration and the person is reckless in relation to that result.

Maximum penalty:     100 penalty units.

    (2)     Strict liability applies to subsection (1)(a).
