FOOD ACT 2004 - SECT 130

Protection from liability

    (1)     This section applies to a person who is or has been:

        (a)     the Chief Health Officer;

        (b)     the chief executive of an enforcement agency or another officer or member of the staff of the enforcement agency;

        (c)     a member of an enforcement agency;

        (d)     an authorised officer; or

        (e)     an approved analyst or a person carrying out analyses under the supervision of an approved analyst.

    (2)     The person is not civilly or criminally liable for an act done or omitted to be done by the person in good faith in the exercise or purported exercise of a power, or the performance or purported performance of a function, under this Act.

    (3)     Subsection (2) does not affect any liability the Territory would, apart from that subsection, have for the act or omission.

    (4)     This section has effect subject to Part VIIA of the Police Administration Act 1978 to the extent it relates to the civil liability of an authorised officer who is or has been a member of the Police Force.
